These Terms of Service (the "Terms") govern your use of the mobile game application and related website collectively named Makeup Sort 3D Puzzle (the "Game / Services"), owned and operated by Makeup Sort 3D Puzzle ("we", "us", "our").

By downloading, installing, accessing or using the Services, you agree to be bound by these Terms and comply with all applicable laws and regulations. We reserve the right to revise and amend these Terms at our sole discretion and publish updates on our website. Amendments shall take effect immediately upon publication. Your continued use of the Game after publication of revised Terms constitutes your acceptance of changes. If you do not agree to these Terms or any updated version, you must stop accessing and using our Services.

Please read these Terms carefully each time before you use the Game. These Terms constitute the full agreement between you and us for use of the Services, unless a separate written contract has been executed. We provide the Game only on condition of your full acceptance of these Terms. If you accept these Terms on behalf of a legal entity, you warrant you hold legal authority to bind such entity. If you lack such authority or reject any part of these Terms, you are not permitted to use the Services.

1. ACCOUNT & ELIGIBILITY

To use our Game, you must be at least 18 years old and capable of entering into a legally-binding contract. If you are under 18, you may use the Game only with consent and supervision of your legal guardian.

You may use guest mode or register a game account. When registering an account you shall provide accurate and complete information. You shall keep your account credentials confidential; you are fully responsible for all activities conducted under your account. You shall not transfer, sell, rent or share your game account with third parties.

The Game offers free-to-play gameplay with optional in-app purchases for virtual in-game items such as boosters, lives and other consumables.

2. DESCRIPTION OF SERVICES

Makeup Sort 3D Puzzle is a casual sorting puzzle mobile game with a sweet art style, designed for tidying and relaxation. Players progress through levels by sorting makeup items, traveling through different beauty routines under the theme of a colorful cosmetic boutique. The overall visual style uses soft pastel colors interwoven with light blue and warm pink, creating a comfortable and satisfying ASMR-like experience.

3. USER-GENERATED CONTENT (UGC)

User-Generated Content means nicknames, profile avatars, feedback, comments and other materials you submit within the Game or on our official website ("UGC").

1.You shall retain your intellectual property rights over your original UGC. By submitting UGC to our Services, you grant us a world-wide, non-exclusive, royalty-free, transferable license to use, host, display, reproduce, adapt and distribute your UGC solely for operating, maintaining and promoting the Game. This license survives termination of these Terms to the extent reasonably required for residual service operation.

2.You warrant that all UGC you submit does not infringe third-party copyright, trademark, privacy, reputation or any other legal rights and complies with these Terms and applicable law. You bear full responsibility for your UGC.

3.We may moderate, edit or remove any UGC in our sole discretion if it violates these Terms or applicable law, without prior notice.

4.The Game does not include any AI-generated-content or AI image-generation feature. Users do not submit text prompts, and the Services do not generate, render or output any image, artwork or other asset based on user content. Accordingly, no generation quota, generated-result ownership, model-training, or public or private generation settings apply under these Terms, and we do not use any user content for AI model training.

4. FEES, IN-APP PURCHASES & VIRTUAL ITEMS

(a) In-App Purchases. The Game includes optional paid in-app purchases for virtual game items (boosters, lives, in-game tokens etc.). All prices are displayed within the Game store or our official pricing page. You authorize the relevant payment processor to charge your selected payment method for completed purchases. Virtual currency and virtual goods are licensed limited-use in-game assets. They have no real-world monetary value, cannot be exchanged for cash, resold or transferred outside the Game environment.

(b) Virtual Currency Restrictions. Any virtual currency (such as Coins or Gems) provided within the Game is a limited-use in-game asset with no real-world monetary value. It cannot be exchanged, redeemed, converted or cashed out for fiat currency, cash or any other valuable consideration. Virtual currency cannot be transferred, gifted, sold or traded between players. Different types of virtual currency (for example Coins and Gems) are separate and non-convertible: they cannot be exchanged or converted into each other, into any other virtual item or reward, or into any other valuable consideration. Any attempt to do so through any means is strictly prohibited and may result in the suspension or termination of your account.

(c) Refunds. Payments for completed in-app purchases are non-refundable, except where required by mandatory applicable consumer law. If your payment fails, we may restrict access to paid virtual items until successful payment is completed.

(d) Price Adjustment. We may adjust pricing for in-app items. Price changes will be posted inside the Game or our website and take effect for future purchases. Past completed transactions shall not be retro-actively modified.

5. DMCA COPYRIGHT TAKEDOWN NOTICE

We comply with the Digital Millennium Copyright Act ("DMCA"). If you believe your copyrighted work has been infringed by content appearing within our Game or website, send a complete takedown notice to [email protected].

Your notice must contain:

• Identification of the copyrighted work allegedly infringed;
• Specific location / description of the allegedly infringing material;
• Your full legal name and valid email contact information;
• A good-faith statement that the unauthorized use is not permitted by copyright owner, agent or law;
• Statement that notice information is accurate;
• Statement under penalty of perjury that you are authorized to act for the copyright owner;
• Your physical or electronic signature.
• We may forward your takedown notice (including contact information) to the user responsible for the material. Users found repeatedly committing copyright infringement may have their game account terminated.

6. INTELLECTUAL PROPERTY RIGHTS

All title, ownership and intellectual-property rights in the Game, including game code, artwork, character designs, sound effects, UI/UX design, level layouts, trademarks and brand logos belong to Makeup Sort 3D Puzzle or our licensors.

We grant you a limited, revocable, non-exclusive, non-transferable personal license to download, install and use the Game for your own personal entertainment purpose subject to these Terms.

You must NOT:

• Reverse-engineer, decompile, disassemble, modify the Game application or any of its components;
• Copy, distribute, rent, sell, sublicense or create derivative works based upon our game assets for commercial purposes without our prior written consent;
• Remove copyright, trademark or proprietary notices embedded within the Game files.
• You may take screenshots or short gameplay video clips for personal non-commercial sharing on social-media platforms.

All rights not expressly granted to you under these Terms are fully reserved by us.

7. TRADEMARKS

All game-related names, logos, slogans and brand marks are trademarks of Makeup Sort 3D Puzzle. You shall not use these trademarks without our prior written permission. Third-party trademarks shown within the Game belong to their respective owners.

8. PROHIBITED USE

When using the Game you agree you will NOT:

• Use cheats, bots, modifications, exploits, third-party tools to alter game logic, obtain unfair advantage or tamper with game data;
• Engage in harassment, hate speech, threats, defamation, obscenity or publish illegal content via in-game chat, nickname, avatar or feedback channels;
• Violate applicable local, national or international laws;
• Attempt to access other users' accounts or personal data without explicit consent;
• Use the Game for commercial-related activities such as account farming, virtual-item resale, advertising or spam distribution;
• Circumvent our technical protective measures or service restrictions;
• Submit UGC containing violence, discrimination, pornography, depiction of harm to minors or animals, or other content contrary to public morality.

Any violation of this clause may result in immediate suspension or permanent termination of your game account. Upon account termination caused by breach of Terms, we are not obligated to provide refunds for unused virtual items. We may also report illegal conduct to relevant law-enforcement authorities as appropriate.

9. TERM AND TERMINATION

These Terms remain effective while you use our Services. You may stop using the Game at any time. We may suspend or terminate your game-account access without advance notice if you materially breach these Terms, or engage in suspected fraudulent or illegal conduct. Termination shall be without prejudice to other remedies available to us under applicable law. Upon termination you lose all access to paid virtual in-game items.

10. DISCLAIMER OF WARRANTIES

Your use of the Game is at your own risk. The Services are provided on an "AS-IS" and "AS-AVAILABLE" basis. To the maximum extent permitted by applicable law, we disclaim all express or implied warranties including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted, error-free game operation; we do not guarantee error-free offline mode performance, network-connected features or absolute data security. Some jurisdictions do not allow exclusion of certain consumer-related implied warranties; in such jurisdictions relevant disclaimers apply only to the maximum extent legally permitted. You acknowledge inherent internet-security risks for online-connected features.

11. LIMITATION OF LIABILITY

To fullest extent permitted under applicable law, neither Makeup Sort 3D Puzzle, its affiliates, employees, agents nor licensors shall be liable for indirect, incidental, consequential, special or punitive damages arising from your use or inability to use the Game, including loss of data, loss of game progress, lost profits or emotional distress, regardless of legal theory, even if foreseeable.

Our aggregate total liability arising from these Terms shall not exceed the greater of (i) total amount you paid for in-game purchases in the 12-month period before claim arises, or (ii) one hundred United States Dollars (USD 100). This limitation shall not apply where statutory law prohibits limitation of liability.

12. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Makeup Sort 3D Puzzle, its officers, employees, contractors and affiliates against all claims, damages, losses, costs and reasonable attorney fees arising out of: (i) your use of the Game; (ii) your UGC submission; (iii) your breach of these Terms; (iv) violation by you of applicable law or third-party rights. We reserve the right to take exclusive control over defence of any indemnified claim, at your cost.

13. THIRD-PARTY LINKS

Our website or Game may contain links to third-party websites or services. Links are for convenience only. We exercise no control over third-party content and assume no liability for third-party services. Accessing third-party resources is entirely at your own risk and subject to respective third-party terms.

14. SEVERABILITY

If any provision of these Terms is found wholly or partially void or unenforceable, that provision shall be severed, and remaining Terms shall remain in full force and effect.

15. GOVERNING LAW

These Terms and your use of Services shall be governed and construed under the laws of Hong Kong Special Administrative Region, without giving effect to conflict-of-law rules.

16. DISPUTE RESOLUTION; ARBITRATION

Any dispute, controversy or claim arising out of or relating to these Terms or use of the Game shall be submitted to final and binding individual arbitration, instead of litigation before court judge or jury. You waive right to jury trial. Arbitration shall proceed on individual basis only. Class-action arbitration and class-action claims are not permitted; you waive rights to participate in any class-action proceeding.

Your use of Services is also governed by our Privacy Policy, which explains how we collect, store and process personal information.
